Contest Terms & Conditions By submitting an entry, each entrant agrees to the rules as noted below and warrants that his or her entry complies with all requirements. Sponsor Air Play Balloon Count contest is sponsored by The New 42nd Street (“Sponsor”), doing business as The New Victory Theater, operating at the business address of 229 W 42nd Street, New York, NY, 10036, USA. Time Frame Air Play Balloon Count contest begins February 14, 2022 at 1pm US Eastern Time and ends February 27, 2022 at 5pm US Eastern Time. All dates are subject to change. The Sponsor reserves the right to cancel or modify any contest not capable of completion as planned. Entry Instructions & Eligibility Requirements The potential winner(s) will be selected and notified via direct message on either Facebook, Instagram or Twitter (depending on which platform the winner entered), at Sponsor’s discretion, within seven (7) business days of the contest close. If a potential finalist/winner does not respond to the notification attempt within three (3) days from the first notification attempt, then such potential finalist/winner may be disqualified and an alternate potential finalist/winner will be selected. If a potential winner is unable for whatever reason to accept his or her prize, the Sponsor reserves the right to award the prize to another entrant. The winner will be the person who guesses closest to the number of balloons in the photo posted on Facebook, Instagram and Twitter. If there is a tie, the winner will be chosen at random. The selection is final and binding. Prize Four orchestra tickets to Air Play at the New Victory Theater between March 4–6, 2022. The approximate retail value of the prize is $197. The prize is non-transferable and no cash alternative is available. Sponsor reserves the right to substitute a prize of equal or greater value if the original prize is unavailable. All federal/state/local laws and regulations apply. Income and other taxes, if any, are the sole responsibility of the winner. Prize will be available to pick up at the New Victory Box Office. Rights of Use All entry materials become the property of The New 42nd Street and will not be acknowledged or returned. Entrants represent and warrant that their submission is their original work, has not been copied from others, and does not violate the rights of any other person or entry. If the entry contains any material or elements that are not owned by the entrant, the entrant is responsible for obtaining, prior to submission, any and all releases and consents. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release. The copyright in any submission remains the property of the entrant, but entry in this contest constitutes entrant’s irrevocable, perpetual permission and consent, without further compensation or attribution, to use the submission and the entrant’s name, likeness, and winning entry for editorial, advertising, commercial and publicity purposes by the Sponsor and/or others authorized by the Sponsor, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the submission, except where prohibited. The Sponsor and/or others authorized by the Sponsor shall have the right to edit, adapt, and modify the submission. Privacy Entrants agree that personal data submitted with an entry, including name, mailing address, phone number, and email address may be used by Sponsor and its affiliates for the purposes of conducting and administering the contest. By entering the contest, entrants consent to receive notification of future promotions, advertisements or solicitations by or from Sponsor via email, direct mail or other means of communication. All personal information collected is subject to the New 42nd Street Privacy Policy. Disclaimer & Liability Limitations The contest is void where prohibited and is subject to all federal, state, and local laws and regulations. By entering this contest, all entrants agree to release, discharge, and hold harmless The New 42nd Street and its and employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this contest or any contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
